The Barcelona Chamber of Commerce, Industry and Navigation (hereinafter “the Chamber”) is a public law corporation regulated by Spanish Law 3/1993 of March 22nd, on official chambers of commerce, industry and navigation, and the Law 14/ 2002, of June 27th, of the official chambers of commerce, industry and navigation of Catalonia and the General Council of Chambers. 

CONDITIONS AND THEIR ACCEPTANCE BY THE USER 
This document (hereinafter "the Legal Notice") regulates the use of the website that the Chamber places at the disposal of the public at the URL http://www.barcelonaesmoda.com. The use of this website by any third party confers on them the status of user, and presupposed their acceptance of all the conditions established by this Legal notice.

CORRECT USE OF THE WEBSITE 
The user undertakes to use the website, its content and the services it offers in accordance with the law, this Legal Notice, common decency and public order. The user also undertakes not to use this website or the services it offers to ends that are illicit or that have harmful effects or that contravene this Legal Notice, that may prejudice the interests or rights of third parties, or that in any way may damage, render inoperative, or degrade the website or its services, or impede the normal use or enjoyment of the website by other users. The user undertakes expressly not to destroy, alter, render inoperative or in any other way to spoil data, programs or electronic or other documents that are to be found on the website. The user undertakes not to obstruct or deny other users access to the service by means of massive consumption of the computational resources whereby the Chamber provides the service, nor in any way to damage, interrupt or generate errors in these computational systems. The user agrees not to introduce into these systems programs, viruses, macros, mini-applications (applets), ActiveX-type controls or any other instruction or sequence of characters that cause or may cause any type of alteration in the computer systems belonging to the Chamber or any third party. The user undertakes not to make malicious or inappropriate use of information, messages, graphics, pictures, sound or image files, photographs, recordings, software or, in general, any type of material that is accessible via the web or the services it provides.

This website and all its contents, including texts, documents, photographs, graphics, databases, software, as well as logos, brand names, commercial or company names are the property of the Chamber or of third parties who have authorised their use. All rights are reserved. Access to this website is subject to the following conditions:
The Camber is not responsible for information that may be obtained from links to external systems.
The Chamber does not guarantee that the website and the server that hosts it are free from viruses and it does not accept responsibility for any damage caused either by accessing the website or by the impossibility of accessing it. In no case will Cookies, or other mechanisms serving an analogous purpose that may be employed, be used to store information that identifies the individual user of the web.
Users or third parties, except when explicitly authorized by the Chamber, may not create links from websites belonging to third parties to any web pages belonging to the Chamber other than the main page of its website, accessible at the URL http://www.barcelonaesmoda.com, or any URL that may replace it in future; nor may they present pages from the Chamber’s website or the information contained therein in under any name, distinctive sign, brand names, official company or commercial names of any other person, company or institution. 

RESPONSIBILITIES

Responsibility of the Chamber for the use of the website 
The user accepts sole responsibility for any infractions they may commit or any damage they may cause or be subject to due to their use of the website and the Chamber is exonerated of any responsibility that may derive from the actions of the user.
The user accepts sole responsibility for any legal, judicial or extrajudicial claim or action initiated by any third party against the Chamber due to the use of the website by the user. In this case, the user will assume responsibility for all expenses, costs and compensations that may be demanded of the Chamber based on complaints or legal action.
 
Responsibility of the Chamber for the functioning of the website 
The Chamber expressly disclaims any responsibility that may be due to interference, omissions, interruptions, computer viruses, breakdowns in the telephone system or operational malfunctions in the electronic system, arising from causes beyond the control of the Chamber.
The Chamber also expressly disclaims all responsibility that may derive from delays to or suspension of the operation of this electronic system caused by technical faults in or overloading of the telephone lines or the Internet or damage caused by third parties by unlawful interference beyond the Chamber’s control.
 
Responsibility of the Chamber for links 
The Chamber disclaims all responsibility for all information not hosted on the website. The function of the links that appear on the website is strictly to inform the user of the existence of other sources of information on a particular topic.
The Chamber disclaims all responsibility for the functioning of links, for the results obtained through the use of these links, for the accuracy and legality of the content or information which may be accessed via them, as well any damage that may be suffered by the user due to the information found on any external webpage to which a link leads.

COMMITMENT TO DATA PROTECTION AND COMPLIANCE WITH SPANISH LAW
In compliance with the provisions of Spanish Law 15/1999 of December 13th, on the Protection of Data of a Personal Character, the Chamber informs all users that any personal information with which they provide the Chamber when they complete the form included on this page will be collected in files for which the Chamber is responsible, and will be used only to provide corporate services. It may also be included in lists of companies requested by third parties that wish to make contact with persons or companies XXX of the Chamber, or that have or have at some time had any kind of relationship with the Chamber; and may be provided to persons, organizations, companies based in Spain or abroad, whose offices may be located in jurisdictions that do not have data protections laws equivalent to those applicable in Spain.  By using any of the forms provided on this website, the user accepts that the information and the personal data that they provide are their own, are accurate, and true.
The registered user may at any time exercise their right to access, correct or cancel the data submitted. In compliance with Spanish Law 34/2002 of July 1st, on services to the information society and electronic commerce, the user may at any time revoke their consent to receive messages of a commercial nature. JURISDICTIONAL ISSUES
Any legal dispute that may arise from the interpretation or execution of this Legal Notice will be governed by Spanish Legislation. Both the Chamber and the user expressly waiving their right of recourse to any other jurisdiction, hereby submit to the jurisdiction of the place of residence of the user for the resolution of any dispute that may arise. In the case that the user's place of residence is outside Spain, the Chamber and the user hereby submit to the Courts of the city of Barcelona.
